This AUP is incorporated by reference into the Dubsof Master Terms of Service and all applicable Product Terms.

  • (d) is inconsistent with the Master Terms, applicable Product Terms, or any reasonable written instructions issued by Dubsof.

2. Prohibited Content and Activities

2.1 Illegal content and unlawful activity

You must not use the Services to create, process, generate, transmit, store, host, display, or make available:

  • content that is unlawful under Applicable Law;
  • material that infringes intellectual property rights, confidentiality obligations, or other proprietary rights;

  • material or activity that breaches sanctions, export controls, or other trade restrictions applicable to you or to Dubsof.

2.2 Child sexual abuse material and child exploitation

You must not use the Services in connection with child sexual abuse material, grooming, sexual exploitation or abuse of children, material that sexualises minors, or any conduct that would require urgent intervention by law enforcement.

2.3 Children’s personal data

You must not use the Services to collect, process, store, or otherwise handle personal data of individuals under the age of 18 unless: (a) Dubsof has given prior written consent; and (b) you have demonstrated compliance with all applicable legal and regulatory requirements relating to that processing.

2.4 Harmful abuse and harassment

You must not use the Services to engage in or facilitate unlawful harassment or abuse, unlawful discrimination, threats of violence, stalking, doxxing, intimidation, coercive conduct, or publication of personal data in breach of Applicable Law.

2.5 Malware and harmful code

You must not use the Services to create, host, distribute, deploy, execute, or facilitate malware, ransomware, spyware, trojans, viruses, worms, malicious scripts, credential theft tools, keyloggers, code intended to evade detection or disable security, or any mechanism intended to disrupt, damage, or impair systems, data, networks, or devices.

2.6 Unauthorised access and security abuse

You must not:

  • attempt to gain unauthorised access to any account, system, network, database, application, or environment;
  • probe, scan, or test the vulnerability of the Services or any third-party system without express authorisation;
  • bypass, disable, or interfere with authentication, access controls, logging, rate limits, or other security measures;
  • interfere with or disrupt the integrity or performance of the Services; or
  • use the Services to support or facilitate denial-of-service attacks, botnets, credential stuffing, or other abusive technical activity.

2.7 Privacy and data protection misuse

You must not use the Services in a manner that breaches data protection law, privacy law, or confidentiality obligations; processes personal data without an appropriate legal basis; misuses personal data for unauthorised profiling, surveillance, or intrusive monitoring; attempts to re-identify anonymised data; or causes Dubsof to process personal data outside the agreed legal and contractual framework.

2.8 Misleading or unsafe regulated use

You must not use the Services for any activity that falsely purports to be approved by Dubsof, misrepresents the origin or legal status of content or applications, is likely to expose individuals to material harm through deceptive or unsafe operation, or requires licences or professional authorisations that you do not hold.

3. AI-Specific Restrictions

This Clause 3 applies to Services that utilise artificial intelligence or machine learning, including Atrium Beta and AI features.

3.1 Prohibited AI uses

You must not use AI-powered Services to:

  • generate malware, exploits, vulnerability scanners, weapons-related code, or other harmful technical content;
  • generate content designed to deceive, manipulate, or defraud, including deepfakes, impersonation content, or synthetic media intended to mislead;
  • generate applications intended to collect or process data of individuals under 18;
  • deliberately reproduce specific third-party proprietary code or content, or systematically extract training data or model outputs;
  • create, train, develop, or improve any product, service, or model that competes directly with the Services using outputs from the Services;
  • resell, sublicense, or make AI-generated outputs available to third parties on a standalone basis as an AI service; or
  • misrepresent AI-generated outputs as human-authored where such representation would be misleading or where disclosure of AI involvement is required by Applicable Law.

3.2 Responsible AI use

You are solely responsible for reviewing, testing, validating, and ensuring the accuracy, safety, security, and legal compliance of any AI-generated outputs before use, deployment, or distribution. Dubsof does not warrant the accuracy, originality, safety, or fitness of AI-generated outputs.

4. Platform and Infrastructure Protections

4.1 Fair and safe use

You must use the Services in a manner that is technically reasonable and does not impose disproportionate strain on the platform or hosting infrastructure.

4.2 No misuse of capacity

You must not deliberately or recklessly exceed agreed or provisioned technical limits in a way that materially affects the Services, conceal or manipulate usage patterns to avoid charges or operational controls, degrade other users’ experience, or circumvent any capacity, metering, throttling, or protective measure.

4.3 No resale of platform access

You must not sublicense, resell, or transfer direct access to the platform itself except as expressly permitted in applicable Product Terms.

5. User Responsibilities

You shall:

  • keep account credentials and access methods secure;
  • maintain accurate and up-to-date contact details;
  • ensure that your personnel, contractors, and authorised users comply with this AUP;
  • cooperate reasonably with Dubsof in investigating suspected misuse, security incidents, illegal content notices, and compliance concerns; and
  • take prompt remedial action where requested by Dubsof.

You are responsible for the acts and omissions of your personnel, contractors, agents, and authorised users in connection with the Services.

6. Reporting Illegal Content, Security Issues, and Abuse

6.1 If you become aware of illegal content, suspected child exploitation material, malware or security compromise, unauthorised access, or any complaint or regulatory inquiry relevant to the Services, you shall notify Dubsof without undue delay at legal@dubsof.com.

6.2 Any notice should, where reasonably possible, include: a clear explanation of the issue; the specific location of the relevant content or activity; your name and email address (except where anonymity is justified); and a statement of good faith belief that the information is accurate.

6.3 Where a matter involves an immediate threat to life, child safety, serious criminal conduct, or an urgent security threat, you should contact the relevant emergency services or law enforcement in addition to notifying Dubsof.

7. Enforcement and Remedies

7.1 Investigation. Dubsof may investigate any suspected breach of this AUP or any activity that Dubsof reasonably considers unlawful, harmful, abusive, or risky.

7.2 Cooperation. You shall provide such information and reasonable cooperation as Dubsof may request in connection with any investigation or incident response.

7.3 Action Dubsof may take. Where Dubsof reasonably considers that a breach has occurred or may occur, Dubsof may:

  • issue a warning;
  • require remediation within a specified timeframe;
  • disable access to particular content, accounts, functions, or applications;
  • suspend or restrict access to the Services;
  • remove or disable access to content;
  • notify relevant users;
  • notify law enforcement, regulators, rights holders, or other competent authorities; and
  • terminate the relevant agreement or access rights.

7.4 No obligation to monitor. Nothing in this AUP obliges Dubsof to monitor all activity on the Services. Dubsof may use manual or automated means to detect, prevent, and address misuse, subject to Applicable Law.

8. Relationship with Other Documents

This AUP forms part of the legal framework governing the Services and must be read together with the Master Terms, applicable Product Terms, the Dubsof Privacy Policy, the Dubsof Cookie Policy, and any applicable DPA.

In the event of inconsistency, the applicable signed or accepted agreement shall prevail, except to the extent that this AUP gives Dubsof additional rights to investigate, restrict, suspend, or terminate misuse.

9. Changes to this AUP

Dubsof may update this AUP from time to time. Where a change is material, Dubsof shall provide advance notice in accordance with Clause 14 of the Master Terms. Continued use of the Services after the effective date constitutes acceptance, subject to any contrary rights in the Master Terms or applicable Product Terms.

This AUP is governed by Irish law and subject to the jurisdiction provisions in the Master Terms.
